Description of terms

Customer – a physical individual who places order in the online store Stivits.com and is the recipient of the ordered Product. The Customer uses purchased Product at Stivits.com online store for his/her personal needs, for the needs of his/her family members and/or familiars, or other purposes.

Seller – Stivits.com

Online store – a website on the Internet network that has a domain address Stivits.com. The Product processed in online store by Seller is offered to Customer as well as

terms of payment and delivery of ordered Product.

Product – a material unit that is in the circulation of goods and is offered for sale on the website.

Order – a duly executed request of the Customer for delivery of the Goods selected on the Website by Customer to specified by Customer delivery address.

1. General Provisions

1.1. By ordering Product of online store through the Stivits.com Customer agrees to the terms of sale of the Product (hereinafter referred to as the Terms), which are explained below.

1.2. The aforementioned Terms, as well as information about Product and agreement posted on the Website, are public available.

1.3. The mutual agreement between Customer and Seller is governed by the legislation of the European Union and/or local law of the country.

1.4. Seller reserves the right to make amendments to these Terms.

3. Execution of the order and execution deadlines

2.1. Customer can place an Order independently using Order processing form on the website. In more details, the checkout is described in the section “How to shop”.

2.2. Making an Order Customer indicates the following information:

Name, Surname, E-mail address, Phone number (optional, for delivery needs), Address, Postal code, City, Country, Product color (if necessary), Product size (if necessary), Payment method,

if to follow up on order with a tracking number, a comment (for example, by typing a coupon code, your body size, to make it easier and more accurate for us to find exactly the size of clothing you need) and agreement to the store’s terms of use.

2.3. After successfully completed Order, an invoice is sent to Customer e-mail address within a day.

2.4. If Customer placed an Order in a quantity that exceeds the quantity of the specified product in the manufacturer’s warehouse, Seller shall inform Customer thereof by sending an e-mail to an e-mail address indicated by Customer during registration. Customer has the right to pay for Product and receive it in quantity in which Product is available in the warehouse or to cancel missing position in Order. As an alternative solution Customer can accept Seller’s proposal to postpone the execution of Order until the specified Product is available in the manufacturer’s warehouse in the required quantity. If Customer has not made an agreement with the Seller within 7 working days, the Seller has the right to cancel Order.

2.5. Delivery term of Product depends on the timely made payment of Order by the Customer.

2.6. Information placed on the Website cannot fully reflect the characteristics of the product (including color, dimensions, technical parameters, shape). Before placing an Order, the Customer has the right to contact Seller with clarification of the product details. If Customer has not turned to the Seller for detailed explanations, it shall be considered as Customer has not encountered doubts about the characteristics of Product during placement of Order.

2.7. In cases where Customer refuses from a partially or fully paid but not sent Order, cancelled Order amount shall be returned to the Customer.

2.9. The product descriptions posted in the stivits.com online store are of informative nature only and the use of the given information does not create legal obligations between the visitor and the owner of the online store. Product description may not meet the criteria of the Customer’s information requests.

2.10. The owners of online store stivits.com are not responsible for transferring the color parameters of the photos to the Customer’s display.

3. Delivery

Delivery in our online store throughout Baltic Countries has delivery time 2-3 working days after payment of the invoice, European Union 3-10 working days, worldwide delivery 5-30 working days if Product is in stock. Delivery time depends on the distributor of the product. Read in more details in section “Delivery”.

4. Payment for Product

4.1 The price of the product is indicated on the website. In case if an incorrect price of the ordered Product was indicated, the Seller shall inform the Customer at the first opportunity to cancel or to confirm Customer’s Order. If it is not possible to contact the Customer, Order shall be considered cancelled. If Order was paid, Seller fully returns the payment amount.

4.2 Order is accepted for further processing only after payment of entire amount of Order value is received by Seller.

4.3 Payment processing is provided by payment platform makecommerce.lv, therefore our company transfers personal data necessary for an execution of payments to the owner of the platform Maksekeskus AS.

5. Intellectual Property

5.1 Copying any textual information and graphic images published on the website is prohibited. The brand, trademark name and logos of the website stivits.com belong to their owner.

6. Warranties and liability

6.1 Seller shall not be liable for the loss incurred by Customer as a result of improper use of Product.

6.2 Seller is not responsible for a content and functionality of external websites.

6.3 Seller has the right to return or transfer rights and obligations in mutual relations with the Client to third parties.

6.4 Product descriptions in the online store stivits.com have informative purposes only. Use of this information does not create legal obligations between a visitor and the owner of online store.

The accuracy of Product description may not meet criteria of Customer’s information request.

6.5 The owners of online store stivits.com are not responsible for transferring the color parameters of the photos to the Customer’s display.

7. How to make a purchase

• Select product (you can use different categories of Products as well as filters for more comfortable filtration and search of Products).
• After choosing necessary Product place it in virtual basket.
• By opening your virtual basket, you can review all your selected products and check-out/continue shopping.
• Choose delivery type.
• Indicate delivery address and other necessary information.
• Make a payment.

After placing an order, you will receive confirmation e-mail with detailed description of ordered Products and prices of it.

8.1 The mutual agreement between Customer and Seller is governed by the legislation of the European Union and/or local law of the country.
