Customer of stivits.com, who is a consumer (a physical individual), has the right within 14 (fourteen) days without giving a reason to withdraw from the contract (“Agreement”) concluded between Buyer and HYPERPHARM OÜ (“Seller”) for the purchase of goods (“Product”) in online store stivits.com.

The term for the right of withdrawal expires after 14 days from the date of Product receiving by Customer. If Customer has ordered several Products in one order, which are delivered separately, the start period the right of withdrawal shall be considered from the day when Customer or a third party (who is not a carrier) and which the Buyer has indicated has received the last Products. If delivered Product consists of several consignments or parts, the start period of withdrawal shall be considered from the day when Customer or a third party (who is not the carrier) and which Customer has indicated, has received the last consignment or part of Product. For contracts of Product regular delivery the start period of withdrawal shall be deemed to be from the day on which Customer or a third party (who is not the carrier) and which Customer has indicated has received the first Products.

In order to proceed with a withdrawal Customer must inform Seller of the decision to withdraw from the Contract by filling in the withdrawal form (link to the form), which includes Customer’s notice of withdrawal from the Contract, or request by e-mail can be sent to mail info@stivits.com. After receiving Customer’s notification in electronic form, Seller immediately sends Customer a confirmation to the Customer’s e-mail address.

In order to comply with a term of withdrawal right, it is sufficient if Customer sends his notice of withdrawal to the Seller before the period of withdrawal right expiration.

Consequences of withdrawal right utilization

If Customer withdraws from Contract, Seller will refund all money paid for Product, including delivery costs (with the exception of additional costs incurred due to the fact that Customer has chosen a delivery method that is not a cheapest standard type of delivery offered by Seller), without undue delay and in any case no later than within 14 days from withdrawal notification sent by Customer to Seller. If only a part of Product is returned, delivery costs are reimbursed only if a lower fee is applied to the remaining Products of the same order when purchasing them separately than the one that applies when purchasing Products together with Product that are subject to return, and only in an amount equal to the difference in the specified fees.

Seller shall transfer refunded amount to the Customer’s bank account specified in the notice of withdrawal from the Contract or in the withdrawal form. In any case, in connection with the return, no funds will be withheld from Customer.

Seller has the right to withhold the refund to Customer until Seller receives Product back or Customer provides Seller with confirmation of Product sent back, whichever is done first.

Customer immediately, but no later than within 14 (fourteen) days after submitting or sending to Seller the withdrawal form or notification of Contract withdrawal, returns Product to the warehouse address specified in return and contacts’ section. The deadline will be deemed to have been met if Customer makes transfer or sends Product to Seller before the expiration of 14 (fourteen) days. Customer shall cover costs of Product return.

Customer is responsible for the decrease of value of Product if Product was used for other purposes during the use of the right of withdrawal but not to clarify the nature, properties and operation of Product. For inspection purposes, the Product can be used to the extent that can be done in the store.
